These Terms of Use constitute a legal agreement between PERCS (PVT) LTD, also known as PERCS, having its principal place of business at Piliyandala, Colombo, Sri Lanka (hereinafter referred to as the "Provider") and the user of the services offered by the Provider (hereinafter referred to as the "User" or "You").

By accessing or using this website and any associated services, tools, software, or platforms provided by the Provider (collectively, the "Services"), you agree to be legally bound by these Terms of Use on behalf of yourself or any entity you represent. The Privacy Policy of PERCS (PVT) LTD (attached as Attachment 1) forms an integral part of these Terms, and by accepting the Terms of Use, you also agree to be bound by the Privacy Policy.

2. Disclaimer

The Provider may amend these Terms of Use at any time without prior notice. Updated versions will be published on the Provider's website. Continued use of the Services after such updates constitutes your acceptance of the revised Terms.

You are responsible for arranging the necessary access to Services, including any devices, internet connections, or applicable fees.

The Provider assumes no liability for content, links, or materials created or shared by third parties. Any reliance on such third-party content is at your own risk.

User-generated content uploaded to the Services is the sole responsibility of the user. The Provider does not endorse or take responsibility for such content.

The Provider is not responsible for the practices, policies, or content of any third-party websites linked from the Services.

3. Service Availability

The Provider commits to maintaining at least 99.5% uptime each month, excluding scheduled maintenance or outages beyond the Provider's control (e.g., internet failures).

4. Restrictions

You agree not to:

• Violate any applicable laws or regulations.
• Infringe on any intellectual property rights, including copyright, trademark, or patent.
• Upload, share, or distribute any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of privacy, discriminatory, or otherwise objectionable.
• Engage in any fraudulent, deceptive, or malicious activity.
• Hack, insert malware or transmit harmful code or data to the Services.
• Impersonate others or misrepresent your identity.
• Use the Services in a manner that is commercially unreasonable or harmful to minors.
• Access or use the Services for any purpose not explicitly authorized by these Terms.

5. Indemnity

You agree to indemnify, defend, and hold harmless the Provider and its affiliates, employees, agents, and partners from and against any claims, damages, liabilities, losses, costs, or expenses (including legal fees) arising out of or related to:

• Inability to use the Services.
